THE STRANGE CASE OF DURHAM DA MIKE NIFONG

I have been keeping up with the bizarre case of the three Duke Lacrosse players accused of raping a stripper since the story broke in probably every news outlet in the country in March of this year. Prosecuting the case against these three young men is Durham, North Carolina's District Attorney, Mike Nifong. But yesterday (12/13) new evidence came to light that seems to prove the three Duke Lacrosse players innocent of the alleged rape. Yet, Mr. Nifong seems hell-bent on pursuing "his" case through to what could be a very bitter end for him and his career.

To date: An entire year of Duke's championship Lacrosse team lost, the former coach's life probably in desperate need of damage control, the families of these three Duke Lacrosse players in turmoil and at least one family in financial ruin. All of this due to a whacked out prostitute/stripper/doped-out liar and a district attorney whose behavior in pursuing this case has been strange at best - and is now beginning to look criminal. Nifong never formally interviewed the complainant. It is doubtful that he has even talked to the accuser at all. That alone borders on misconduct on Nifong's part. But there is much more to the strange case of Mike Nifong and his apparent obsession with putting these three young men behind bars and to hell with justice and the civil rights of the accused. This is not the conduct one expects from an officer of the court.

The new news reports regarding the results of DNA tests performed by a lab that Nifong himself hired - indicates that the fluids found on the accuser's underwear, her vaginal and anal cavities do not match the DNA of those three hapless young men. For that matter, the tested DNA doesn't match anyone who submitted samples for testing - including the accuser's boyfriend. However, the lab did find seminal fluids from at least five different "donors" which flies in the face of "victim" statements that she had not had sexual intercourse with anyone for at least a week before the "supposed rape" incident.

So, what is wrong with Mr. Nifong? What dog does he have in this fight? Why is he apparently going out of his way to hang himself with his own rope? Was winning the election for another term as Durham's District Attorney the reason for his highly questionable behavior regarding this case? I don't think so. But could Mike Nifong have an emotional disorder of some kind? I am not a psychologist, although I majored in psychology, but Nifong's conduct jumps out at me as a textbook example of one with pathological narcissist disorder. The possibility that Nifong may also have a substance abuse problem is also something to consider although there is no evidence of that - so far.

It is high time that the governor of North Carolina order the North Carolina Attorney General to select an unbiased special prosecutor to look into the manner in which Nifong has handled the Lacrosse rape case. This would be the appropriate avenue to take in order to see if there may be grounds for removing Nifong from office. This would also keep the Feds out of it since it is a matter for the state and does not belong in a federal court. A state appointed prosecutor would also have the freedom of discovery to see if Nifong has intentionally violated the civil rights of the three Lacrosse players. Then the state of North Carolina could determine if there is enough evidence to press criminal charges against Mr. Nifong.

So, that big black cloud hanging over Nifong's head should be telling him by now that he very well may be facing a hefty fine, loss of his license to practice law with the possibility of his having to spend time behind bars. Nifong is compelled by law to share any exculpatory evidence with the defense. He did not do this. Instead, Nifong withheld the exculpatory evidence that he had in his possession as early as April of this year. Meanwhile, three innocent young men are left twisting in the wind as their lives are being destroyed by what started out as a rape case but now seems to be turning into "The Strange Case Of Durham D.A., Mike Nifong."
